These Terms are entered into by and between you and BB Labs LLC ("Company"), which operates Lastminute.gift.
By accessing or using the Lastminute.gift application and related services such as those provided at Thought.gift ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
Lastminute.gift is a platform that enables users to create and send personalized digital gift cards for local businesses. The Service includes:
We do not operate as a bank or financial institution. Virtual cards are issued by our licensed card-issuing partners.
You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
You may create an account using Apple Sign-In or phone number verification. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.
Payments are processed securely by Stripe, a PCI Level 1 payment processor. Prices are displayed in US dollars.
A 10% service fee is applied to each transaction and is clearly displayed at checkout before purchase confirmation. This fee covers secure payment processing, virtual card issuance, and gift delivery.
Gift cards are issued as virtual Visa gift cards. Once purchased, the selected amount is made available on the card and ready for use at any Visa-accepting merchant.
By completing a purchase, you authorize us to charge the payment method provided for the gift card amount plus the applicable service fee.
Gift cards that have not been activated by a recipient may be cancelled via the cancellation feature in your purchase history. Following cancellation, you may request either a cash refund (returned to your original payment method typically within 3 business days after approval but no later than 10 business days) or a store credit (applied to a future purchase of the same value at checkout). Refund requests are reviewed by our team. Service fees are non-refundable in all cases though will not be recharged when using a store credit. Once a card has been activated by the recipient, refunds are no longer available.
For the protection of both senders and recipients, we require SMS-based identity verification before card credentials are revealed. Recipients must verify their phone number using a one-time passcode sent via SMS. This verification is valid for a limited time, after which re-verification is required.
Our Service uses artificial intelligence to analyze business websites and generate custom gift card designs. AI-generated content (including business descriptions, branding elements, and card designs) is provided for personalization purposes only.

The Service, including its design, features, and content, is owned and operated by BB Labs LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without prior written consent.
Our Service relies on third-party providers for payment processing (Stripe), SMS delivery (Twilio), and virtual card issuance. We are not responsible for the availability, performance, or policies of these third-party services. Your use of payment and card services is also subject to the terms of the respective providers.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:
To the maximum extent permitted by law, Lastminute.gift and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
Our total liability shall not exceed the amount you paid for the specific transaction giving rise to the claim.
You agree to indemnify and hold harmless Lastminute.gift from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of the Service.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of San Francisco County, California.
We may update these Terms at any time. Material changes will be communicated through the app. Continued use of the Service after changes constitutes acceptance of the revised Terms.
